The United States continues to levy anti-dumping taxes on Vietnamese warm-water shrimp

DNHN - The US Department of Commerce (DOC) has now released the final results of the third final evaluation of anti-dumping penalties on warm-water shrimp imported from China, India, Thailand, and Vietnam.

Because warm water shrimp producers/exporters did not respond, DOC performed a "rapid review" within 120 days. The final review's findings will apply to the whole manufacturing industry, rather than to individual businesses.
The DOC found that suspending the anti-dumping tax order on warm water shrimp imported from the four nations listed above would result in the likelihood of dumping continuing or reoccurring. The DOC uses national tax rates to evaluate if dumping is likely to persist or reoccur in Vietnam. As a result, DOC will keep the order imposing anti-dumping taxes on warm water shrimp imported from the four nations listed above.
Since 2004, the US has been conducting an anti-dumping inquiry into warm-water shrimp goods from Vietnam and other nations and has begun to levy tariffs on Vietnamese exporters ranging from 4.30% to 25.76%.
Based on a WTO dispute resolution case, the DOC lifted an anti-dumping duty decision for a Vietnamese firm qualifying under US law in July 2016.
The DOC has since completed the second sunset review. The following four administrative reviews (POR10, 11, 12, 13), two administrative reviews (POR14, 15), and POR16 are being reviewed for the period February 1, 2021, to January 31, 2022. The DOC decided the official tax rates for the two required defendants and the 29 firms that enjoy distinct tax rates, both at 0%, in the final result of the most recent review (POR13).
The Ministry of Industry and Trade will continue to work closely with the Vietnam Association of Seafood Exporters and Producers and Vietnam's shrimp exporters to handle related issues in administrative review and review cases as the period of anti-dumping tax imposed by the United States on Vietnam's warm water shrimp products nears its end.
