DNHN - The Ministry of Planning and Investment has released Circular No. 06/2022/TT-BKHDT guiding several articles of the Government's Decree No. 80/2021/ND-CP outlining and guiding the implementation of many articles of the Law on Support for Small and Medium Enterprises (SMEs).
This Circular takes effect on June 25, 2022, and replaces Ministry of Planning and Investment Circular No. 05/2019/TT-BKHDT dated March 29, 2019, directing assistance for human resource development. 06/2019/TT-BKHDT of the Ministry of Planning and Investment dated March 29, 2019, regulating the regulations on the establishment and operation of the network of consultants, supporting and consulting for SMEs through a network of consultants. If the papers mentioned in this Circular expire and are replaced by another document, the terms of the replacement document will take effect.
Enterprises established, organized, and operating following the law on enterprises and meeting the provisions of Chapter II of Decree No. 80/2021/ND-CP on criteria for identifying SMEs; Ministries, ministerial-level agencies, Governmental agencies, People's Committees of provinces, and centrally-run cities are subjects of application.
SMEs-supporting agencies and organizations; SMEs-supporting suppliers of products and services If the supplier is an organization, it must be created and operate in compliance with Vietnamese legislation.
According to the Circular, SME support agencies and organizations prioritize allocating funds to support women-owned SMEs, SMEs employing a large number of female workers, and SMEs that are social enterprises based on the declaration stipulated in Appendix 1 to Decree No. 80/2021/ND-CP, assess the size of SMEs, women-owned SMEs, and SMEs employing a high proportion of female workers.
In a support need proposal, SMEs might provide numerous support contents. SMEs can only transmit the same support content to one agency or organization that supports SMEs at the same time.
SMEs are not restricted to the number of times they may provide support or the number of support contracts they can engage in for the stated support contents in millions of VND/year/enterprise or millions of VND/year, but they must ensure that the rate and determination are not exceeded. Decree No. 80/2021/ND-CP specifies the highest degree of assistance.
Documents and dossiers presented to the SME support agency or organization that are connected to the substance of the proposal to support SMEs mentioned in Point b, Clause 4, Article 32 of Decree No. 80/2021/ND-CP are copies or photocopies of the original, the original does not need to be validated. Supporting agencies and organizations shall assist by the terms of Articles 4 and 5 of this Circular, as well as some particular regulations, such as assisting SME trainees in participating in domestic and specialized training and training. Foreigners as defined in Clause 5, Article 22 of Decree No. 80/2021/ND-CP, including tuition, paperwork, food, lodging, and transport (including airfare).
Product formulation and development; commercialization of products; e-commerce development; call for investment capital; market development; connecting startup networks; and other content tailored to the needs of innovative start-up SMEs are among the topics covered in short-term intensive training courses abroad.
Small and medium-sized enterprise support agencies and organizations may invest no more than 5% of the yearly state budget to assist small and medium-sized firms with direct administration of support operations.
Support SMEs in maintaining accounts on e-commerce platforms as specified in Point c, Clause 6, Article 22 of Decree No. 80/2021/ND-CP; supporting SMEs in participating in international competitions on innovative start-ups as specified in Point dd, Clause 6, Article 22 of Decree No. 80/2021/ND-CP, including contest fees and charges; eat and stay in the host country; travel (including airfare); transport documents, products, and equipment for participating in
Concerning the selection of small and medium-sized firms (SMEs) in industrial clusters in the sphere of production and processing, the Circular prescribes certain forms of affiliation between SMEs and other enterprises in the cluster as defined in Clause 2, Article 23.
The following are included in Decree No. 80/2021/ND-CP: Legal linkage for the acquisition of input materials: In the form of a contract for the general sale of products: SMEs and at least one other enterprise in an industry cluster have a contract to sell products to one purchasing party; in the form of purchase, sale, and cooperation contracts; in the form of jointly building and using the brand.
