DNHN - The Ministry of Transport is in the process of drafting a Decree amending and supplementing several articles of Government Decree No. 48/2019/ND-CP dated 5 June 2019 regarding the management of service vehicles. Water recreation and amusement.
Consequently, the Ministry of Transport proposes a change to the authority responsible for approving water amusement and entertainment activities in Region 1. By the provisions of Decree No. 48/2019/ND-CP, the approval authority for water amusement and entertainment activities in Region 1 is as follows: Regarding inland waterways: Administration of Vietnam's inland waterways
Department of Transportation; local inland waterways
Vietnam Maritime Administration on seaport waters or maritime areas.
In Decision No. 1015/QD-TTg dated August 30, 2022, the Prime Minister approved the decentralization plan for handling administrative procedures under the management of ministries and agencies, according to the Ministry of Transport. The ministerial agency has outlined the following strategy for decentralizing administrative authority: Procedures for approving aquatic amusement and recreational activities in inland waterways, seaport waters, or zones In the maritime domain (TTHC code: 2.001219), the Department of Transport is delegated the authority to handle administrative procedures from the Department of Inland Waterways, the Vietnam Maritime Administration, and the Provincial People's Committee.
Consequently, in the draught, the Ministry of Transport proposes that the Department of Transport approve water-based amusements in Region 1.
According to the proposal, organizations and individuals send one set of dossiers to the Department of Transportation via the postal service or other suitable means. The Department of Transport receives the dossier; if the application is invalid, it instructs the organization or individual to submit a valid application within two business days of receiving the application.
If the area is an amusement park, the Department of Transport must send a document (along with a set of photocopies) to the regional Sub-Department of Inland Waterways within two business days of receiving a valid application. For comments on water entertainment on a national inland waterway, contact the regional maritime authority if the water entertainment area is located on seaport water or in the maritime area.
The regional Inland Waterway Sub-Department and regional Maritime Port Authority are required to respond in writing within three business days of receiving the written opinion. Within two business days of receiving a written response from the Regional Inland Waterway Sub-Department or the Regional Maritime Port Authority, the Department of Transport shall issue a written approval; in the case of disapproval, the Regional Inland Waterway Sub-Department or Regional Maritime Port Authority must respond in writing and clearly state the reason.
