Pilot project for commercial housing to expand land use rights

DNHN - The National Assembly Standing Committee has submitted a pilot project on commercial housing through land use rights agreements for National Assembly consideration, aiming to unlock resources.
On November 3, the National Assembly Standing Committee reviewed the draft resolution on piloting commercial housing projects through agreements to acquire land use rights or current land use rights, according to the National Assembly's electronic portal.
Minister of Natural Resources and Environment Đỗ Đức Duy presented the Resolution Proposal, stating the pilot's goal is to establish a necessary legal framework for managing the land use rights and real estate market. This resolution aims not only to enable self-negotiation mechanisms between citizens and enterprises but also to reduce administrative intervention, streamline procedures, thereby lowering unnecessary costs and preventing land acquisition-related complaints.
According to the Minister, in the context of rapid urbanization, the need for residential land and housing for citizens is more urgent than ever. The resolution is expected to create a favorable environment for investors and land users to be more proactive in developing commercial housing projects, advancing the nation’s urbanization process.
The resolution specifies that the pilot implementation of commercial housing projects will be nationwide, with defined conditions. Specifically, real estate business organizations can acquire land use rights or current land use rights to develop projects. This includes organizations that must relocate due to environmental pollution or urban planning.
Additionally, the resolution clearly defines the scope of application for government agencies, real estate business organizations, and land users according to the Land Law. This is a crucial step in ensuring transparency and openness in land management.
Chairman of the Economic Committee Vũ Hồng Thanh presented a review report, affirming the necessity of the resolution. However, the Economic Committee also recommended that the Government conduct a detailed, comprehensive assessment of the current status of commercial housing development, including the effectiveness of land funds for housing development in provinces and cities. This is an important point that provides clearer insight into the current development status and existing issues in this sector.
The committee also emphasized the need to assess the status of land speculation and acquisition, along with specific solutions to mitigate negative impacts from the pilot project.
However, implementing this resolution is not without risks and challenges. One of the primary concerns is the potential conflict with existing Land Law regulations. The Economic Committee has also indicated that the resolution's provisions may overlap with those related to forestry, defense, security, and religious and belief grounds.
Therefore, the Economic Committee suggested a thorough review to identify specific land types applicable to commercial housing projects. This measure is intended not only to ensure legality but also to facilitate project development without harming the interests of the involved parties.
During the discussion, several National Assembly deputies expressed their views, stating that the Government should provide additional information and conduct a more detailed assessment of the current state of commercial housing projects. This will help in finding more suitable pilot approaches and addressing the current obstacles faced by many localities.
Some deputies also suggested that the pilot project should not be implemented nationwide but rather tailored to specific areas and urban regions. Not all localities face the same issues, and piloting in areas without obstacles could be a waste of resources.
National Assembly Vice Chairman Nguyễn Đức Hải concluded that the National Assembly Standing Committee agreed to submit to the National Assembly for consideration and decision on piloting the commercial housing project through land use rights agreements. This is not only a major urban development policy but also reflects the Government's commitment to reform, unlocking land resources, advancing socio-economic development, and meeting citizens’ housing needs.
It is clear that these changes will have a significant impact on the real estate market and consumers. However, to succeed, the Government and related agencies need specific plans, thorough assessments of implementation conditions, and close supervision to prevent land speculation or unwanted issues in the future.
The implementation of this resolution will be the beginning of a new journey, where citizens and businesses can collaborate to develop better living environments, promoting sustainable development for the nation in the coming time.
